Acceptance of Terms

By accessing or using this service, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

Description of Service

We provide a software-as-a-service platform. We may modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

Eligibility

You must be at least 13 years old, or the higher minimum age set by the law of your country, to use the service. If you are under the age of majority where you live, you may use the service only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use or security breach.

Acceptable Use

You agree not to:

• Violate any applicable laws or regulations.
• Infringe on the intellectual property or other rights of any party.
• Attempt to gain unauthorized access to our systems or data.
• Interfere with or disrupt the integrity or performance of the service.
• Use the service to send spam, malware, or other harmful content.

What you may and may not create with Yoloo AI is set out in our Acceptable Use Policy, which forms part of these Terms. You must follow it.

We may suspend or terminate access for any account that violates these rules, and we may report suspected illegal activity to the relevant authorities.

Payment and Billing

Paid features are billed in advance for the selected billing period. You are responsible for providing accurate billing information. Credits have no cash value, cannot be transferred, and expire as described in our Refund Policy: monthly plan credits at the end of the billing period, yearly plan credits after one year, and credit pack credits after one year. Refunds and returned credits are handled as described in that policy.

Your Content and Generated Outputs

• You keep the rights you have in the images, videos, and text you upload ("Inputs"). You confirm that you have every right and permission needed to upload them, including consent from any real person who appears in them.
• You give us a limited license to store and process Inputs and generated outputs only to provide and secure the service.
• As between you and Yoloo AI, you own the images and videos you generate ("Outputs") and we claim no ownership of them. Your use of Outputs must comply with these Terms, our Acceptable Use Policy, and applicable law.
• Outputs are made by third-party AI models. Similar outputs may be produced for other users, and we do not guarantee that an Output is unique, eligible for copyright protection, or free of third-party rights. You are responsible for how you use Outputs.
• We do not use your Inputs or Outputs to train AI models.

Copyright Complaints

If you believe content generated or uploaded through Yoloo AI infringes your copyright or other rights, email support@yoloo.ai with: your contact details, a description of the work or right you believe is infringed, the location of the content (such as a link or task reference), and a statement that you believe in good faith the use is not authorized. We may remove or disable access to reported content and may suspend accounts that repeatedly infringe the rights of others.

Intellectual Property

The service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Termination

We may suspend or terminate your access to the service at any time if you violate these terms. You may request account closure by emailing support@yoloo.ai from your account address.

Disclaimer of Warranties

The service and all Outputs are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Outputs are generated by third-party AI models, and we do not guarantee that the service will be uninterrupted or error-free, or that any Output will be accurate, match your expectations, or suit a particular purpose.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of your use of or inability to use the service.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to these Terms or the service is limited to the greater of (a) the amount you paid us for the service in the 12 months before the event giving rise to the claim, or (b) USD 100.

Some jurisdictions do not allow these exclusions or limits, so some of them may not apply to you.

Indemnification

To the extent permitted by law, you agree to indemnify us against third-party claims, and the resulting losses, damages, and reasonable legal fees, to the extent they arise from: (a) your breach of these Terms or the Acceptable Use Policy; (b) Inputs you upload that you did not have the right to upload, including content that infringes another person's privacy, publicity, or intellectual property rights; or (c) your use of Outputs in violation of law or the rights of others.

This obligation does not apply to the extent a claim is caused by our own breach of these Terms, negligence, or misconduct. We will notify you promptly of any claim covered by this section, let you take part in its defense at your own cost, and not settle it in a way that admits fault on your behalf or requires you to pay without your consent.

Changes to These Terms

We may modify these Terms at any time. Material changes are reflected in the date at the top of this page. Changes take effect when posted, and by continuing to use the service after that, you accept the updated Terms. Changes that reduce what you have already paid for, such as your plan's features or the validity of credits you have already purchased, do not apply to your current billing period or to those credits. They apply from your next renewal or purchase. If you do not agree to the changes, stop using the service and, if you have a subscription, cancel it before your next renewal.
